Terms of Use for Kombinlio

Welcome to Kombinlio!
These Terms of Use ("Terms") govern your access to and use of the Kombinlio mobile application and services (collectively, the "Service"), provided by CINAR Technologies ("Kombinlio," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. The Service
Kombinlio provides a virtual photoshoot studio that allows users, primarily businesses, to generate on-model imagery using artificial intelligence. You may upload images of clothing and models ("User Content") to create virtual try-on images ("Generated Content").
2. Acceptable Use Policy (AUP)
Critical Notice: You are solely responsible for all content you upload and create.
You are solely responsible for the User Content you upload and the Generated Content you create. You agree not to use the Service to create, upload, transmit, or store any content that:
- Is Illegal or Harmful: This includes, but is not limited to, any content that is obscene, pornographic, defamatory, or promotes violence or illegal acts.
- Involves Minors: You are strictly prohibited from uploading any image that depicts a person under the age of 18. This includes real photographs, drawings, or any other form of imagery. Creating content that could be interpreted as child sexual abuse material (CSAM) is a severe crime and will be reported to law enforcement authorities immediately.
- Violates Intellectual Property Rights: You may only upload content for which you own the copyright or have obtained all necessary rights and licenses to use it.
- Violates Privacy: You may not upload images of any person who has not given you their explicit consent to be used in this manner.
Warning: Violation of this AUP will result in the immediate termination of your account and may be reported to law enforcement.
3. Mandatory User Declaration
Before uploading any User Content, you will be required to actively agree to a declaration. By checking the box, you affirm and warrant that:
- You are the legal owner of the image or have obtained all necessary rights and permissions to use it.
- The image does not contain any illegal material, including depictions of individuals under the age of 18 and pornographic content.
- You have read and agree to be bound by Kombinlio's Terms of Use and Privacy Policy.
- You understand that violating these terms will lead to immediate account termination and potential reporting to law enforcement.
4. Our Rights
Kombinlio reserves the right, at its sole discretion and without prior notice, to:
- Monitor, screen, and review any User Content for compliance with these Terms.
- Remove any content that it deems to be in violation of these Terms.
- Suspend or permanently terminate any user account for any violation.
- Cooperate fully with any lawful request from law enforcement or judicial authorities regarding any user or content on the Service.
5. Use of Third-Party Services
To provide the virtual try-on feature, Kombinlio utilizes third-party AI APIs, including catVTON and iadge API. By using our Service, you acknowledge and agree that your User Content will be processed by these third-party services as described in our Privacy Policy. Kombinlio is not responsible for the functionality or availability of these third-party services.
6. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Kombinlio makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of the Generated Content. To the fullest extent permitted by law, Kombinlio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
9. Subscription and Payments
Subscription Plan
Weekly Access: $14.99 + Taxes per week.
Free Trial
3-Day Free Trial. If you sign up for the free trial, it will automatically convert to a paid weekly subscription ($14.99 + Taxes) at the end of the 3-day trial period unless canceled at least 24 hours before the trial ends.
Billing
Payment will be charged to your Google Play Account at confirmation of purchase.
Auto-Renewal
Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
Cancellation
You can manage and cancel your subscription by going to your Google Play Account Settings.
